Criminal Cassation, the sentence filed n. 22013 of 14/5/2018
- in the matter of Responsibility pursuant to Legislative Decree 231/01 of the CEO of the contracting company for omitted control of the adoption by the sub-contractor of the health and safety protection measures

On April 6, it entered into force on Legislative Decree 21/2018 containing "Provisions for implementing the principle of delegation of the code reserve in criminal matters pursuant to article 1, paragraph 85, letter q), of law no. 103 of 23 June 2017".
In summary, some criminal laws contained in various regulatory provisions have been repealed and, in some cases, replaced by homologous articles of the Criminal Code.
For the purposes of Legislative Decree 231/01, the following should be noted:
the repeal of article 3 of Law 654/1975 "Racism and xenophobia", recently included in article 25-terdecies, replaced by the 604-bis CP ("Propaganda and instigation to commit a crime for reasons of racial ethnic and religious discrimination") )
the repeal of art. 260 of Legislative Decree 152/2006 instead referred to in article 25-undecies, "Environmental crimes" replaced by art. 452-quaterdecies CP "Organized Activities for Illicit Waste Trafficking"
